Protect lives, ensure legal compliance
Understanding relevant occupational health and safety (OHS) acts and regulations is crucial for ensuring the wellbeing of employees and creating a safe working environment. In South Africa, where industries like mining, construction, and manufacturing are significant, adherence to OHS laws not only protects employees from hazards, but also prevents costly accidents and legal consequences for businesses. For example, the Occupational Health and Safety Act (OHS Act) outlines essential safety standards that help minimise risks, from construction site falls to exposure to harmful chemicals. Staying informed about these regulations is not just a legal requirement, but a vital step in promoting workplace health and productivity.
Strat Training’s LAWREG training course and the Legal Liability training course are essential knowledge tools for all organisations serious about increasing their OHS risk mitigation profile.
LAWREG
The course offers a five-day learning experience that is a combined course of Regulations & Acts, each with their own Unit standard, NQF Level, and Credits where applicable
Regulatory law refers to law promulgated by an executive branch agency under a delegation from a legislature. Discussed at Regulation (law) and Primary and secondary legislation. Administrative law is promulgated by the legislature (and refined by judicial common law) for governing agencies.
Law is a system of rules that are created and enforced through social or governmental institutions to regulate behaviour. It has been defined both as ‘the Science of Justice’ and ‘the Art of Justice’. Law is a system that regulates and ensures that individuals or a community adhere to the will of the state
The following are covered during this course:
Completion of the course consists of an open-book exam.
Legal Liability (Level 4)
This course addresses legal liability within the context of the Occupational Health and Safety Act, 1993.
Many people mistakenly assume that the only penalties that could be imposed on them are those that are stipulated in section 38 of the O.H.S Act, 1993. However, it should be noted that Common Law is, to some extent, always linked to any form of legislation.
Knowing the law, and being aware of what could happen is, far better than being caught unawares. Employees who understand the different liabilities and what they entail are better equipped to implement reasonable measures to avoid or at least minimise legal accountability.
Topics covered will include, but are not limited to, Common Law and Legislation, Criminal Liability, and Civil or Private Liability and Principles of the O.H.S Act, 1993.
The course also looks at the general duties of employees towards their employer, and the general duties of the employee at work.
This course is designed around four modules, covering topics like managing the scene of an emergency, the basic human anatomy and physiology, and the primary and secondary survey.
Unit Standard: 120344 – NQF Level: 4 – Credits: 4
OHASA (OHS Act) (Level 5)
In terms of the Occupational Health and Safety Act (Act 85 of 1993), everyone in your organisation has responsibility for working in a safe and healthy manner. It is not only the employer’s responsibility to ensure that the workplace is safe and healthy, but also the employee’s responsibility to ensure that the workplace is safe and healthy, and also the employee’s responsibility, to care for themselves and the other employees around them.
It is therefore important that all employees adhere to the Health and Safety Policies and Procedures of the organisation. The employer has put these things in place to ensure the health and safety of the employees and visitors on the premises. If you do not comply with the Policies and Procedures, you are in contravention of the Act and could be disciplined accordingly. Because we are dealing with the lives of people, it is of the utmost importance that everyone makes health and safety a principle to live by.
Topics covered will include, but are not limited to, the O.H.S Act, 1993, Safe Working Practices, Emergency Procedures, Housekeeping that includes Environmental Regulations and Moving Machinery and Confined Spaces that includes General Machinery Regulations, Driven Machinery Regulations & Confined Spaces
The course also looks at the general duties of employees towards their employer, and the general duties of the employee at work.
