Legal Liability

This course addresses Legal Liability within the context of the Occupational Health and Safety Act, 1993.

Many people mistakenly assume that the only penalties that could be imposed on them are those that are stipulated in section 38 of the O.H.S Act, 1993. The fact of the matter is, however, that Common Law is, to some extent, always linked to any form of legislation.

Knowing the the law and being aware of what could happen is by far better than being caught unawares. Employees who understand the different liabilities and what they entail are better equipped to implement reasonable measures to avoid or at least minimize legal accountability.

Topics covered will include, but are not limited to, Common Law and Legislation, Criminal Liability as well as Civil or Private Liability and Principles of the O.H.S Act, 1993.
